USA v. Luke Wenke | Plea Agreement | 04/18/2022

In April 2022, Luke Wenke pleaded guilty in federal court to one count of cyberstalking. In exchange for his guilty plea, the prosecution dismissed a charge of making interstate threats and recommended an 18-month prison sentence followed by three years of supervised release.

The first PDF reader below contains a copy of Wenke’s plea agreement. The second PDF viewer features a transcript from Luke Wenke’s plea hearing. Contained within the document is a word-for-word account of what was said during the proceeding.

As the transcript shows, Luke Wenke was given ample opportunity to change his mind about his guilty plea. He swore under oath that no one had influenced or incentivized his decision, yet has claimed in some of his letters to the court over the last year that he was forced to plead guilty at gunpoint.

During his plea hearing, Luke Wenke demonstrated an understanding of his wrongdoings, stating:

“I very inappropriately treated [victim] and dehumanized him and carried on for way too long. And definitely harassed him over e-mails for longer than ever should have happened.”

In addition to admitting to the crime, Wenke swore under oath that he was sober, coherent, and not under the influence of drugs or alcohol. In other words, he confirmed that he was entering his plea in a sound state of mind.
